- 摘要：随着数字经济时代的来临，与土地、劳动力、资本、技术等传统生产要素并列，数据已成为新的生产要素，数据资产化成为新共识，数据的潜在价值通过挖掘和开发，转化为实际价值。数据产权清晰是保证数据高效流通、使用以及资产化的前提和基础，数据确权直接关系到数据价值的开发利用和数据市场的发展。企业需要明确数据在采集及存储、计算、管理、使用全过程中涉及的权利主体、权利属性和权利内容，建立数据确权长效机制，激发数据要素的价值，促进数据资源共享，提升数据要素赋能作用，推进企业数字化转型。Abstract: With the advent of the era of digital economy, along with land, labor force, capital, technology and other traditional factorsof production, data has become a new productionfactor, a new consensus on data assets, and the potential value of data throughmining and development into the actual value. Clarified property right of data is the premise and basis to ensure the efficientcirculation, use and capitalization of data. Data authentic right is directly related to the exploitation and utilization of data value andthe development of data market. Enterprises need to clarify the subject, attribute and content of rights involved in the whole processof data collection, storage, calculation, management and use, establish a long-term mechanism of data authentic right, stimulate thevalue of data elements, promote data resource sharing, enhance the enabling role of data elements, and promote the digitaltransformation of enterprises.
